• Your User Content does not contain unlawful, harmful, or objectionable material

4.3 AI Processing

You acknowledge and agree that your User Content may be processed by artificial intelligence and machine learning systems to provide service features. We do not use your personal content to train general-purpose AI models shared across other users.

5. Prohibited Uses

You agree not to use our services to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Upload or transmit viruses, malware, or other malicious code
• Attempt to gain unauthorized access to our services or systems
• Interfere with or disrupt our services or servers

OUR SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that:

• Our services will function uninterrupted, secure, or error-free
• Results obtained from our services will be accurate or reliable
• Any errors in our services will be corrected
• Our services will meet your specific requirements

AI-generated responses and content analysis may contain errors, inaccuracies, or omissions. You should not rely solely on our services for critical decisions.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL NEURAL FORGE TECHNOLOGIES LLP, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of or inability to access or use our services
• Any conduct or content of any third party on our services
• Any content obtained from our services
• Unauthorized access, use, or alteration of your transmissions or content
• Loss or corruption of your User Content
• Errors, inaccuracies, or omissions in AI-generated responses

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED US DOLLARS ($100), WHICHEVER IS GREATER.

10. Indemnification

You agree to defend, indemnify, and hold harmless Neural Forge Technologies LLP and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses arising from:

• Your use of our services
• Your violation of these Terms
• Your violation of any third party rights
• Your User Content

11. Data and Backups

While we implement measures to protect your data, you acknowledge that:

• We are not responsible for any loss or corruption of User Content
• You are responsible for maintaining your own backups of important data
• Service interruptions may occur and we are not liable for any resulting data loss

We reserve the right to modify, suspend, or discontinue any service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of our services.

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Chhatarpur, Madhya Pradesh, India.

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.

16. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Neural Forge Technologies LLP regarding our services and supersede any prior agreements.
